Rep. Alexandria Ocasio-Cortez (D-NY) is under federal investigation for allegedly hiring an illegal immigrant in her congressional office and for reportedly helping others evade Immigration and Customs Enforcement (ICE) arrests, according to Border Czar Tom Homan.

Homan confirmed in a recent interview that the investigation is underway, stating, “It’s being looked at, can’t comment past that. I’m aware of it, we’ve asked ICE to drill in on that case.” He emphasized that AOC’s actions, including hosting seminars on how illegal immigrants can avoid ICE, could be considered criminal under federal law. “She’s really educating them on how to avoid prosecution,” Homan said.

At the center of the investigation is Diego de la Vega, an illegal immigrant activist who previously interned for Rep. Carolyn Maloney and served as a “special assistant” to a New York assemblyman before being hired in 2022 as AOC’s Deputy Communications Director. Despite his undocumented status, de la Vega held a senior role in AOC’s office, raising questions about how he gained employment in Congress and whether he accessed sensitive information.

De la Vega left the U.S. in March, saying he no longer felt safe under stepped-up Trump administration deportation efforts. His exit came after AOC publicly praised him as “amazing” in an interview, citing his activism and role in pushing for the failed DREAM Act.

The situation escalated after reports revealed AOC was holding sessions advising illegal immigrants on how to avoid detection by ICE, prompting Homan to formally request the Deputy Attorney General to investigate her actions in February.

Critics argue that the potential employment of an illegal immigrant in a congressional office could pose serious security and legal issues, while others say it highlights the tension between immigration enforcement and political activism.

Ocasio-Cortez has not commented publicly on the investigation as scrutiny around her actions grows. The case comes as the Trump administration continues aggressive enforcement of immigration laws, signaling that even high-profile figures will face accountability if found violating federal statutes.
