What goes around comes around—and for former Biden administration officials, that moment has arrived. In a stunning move with major implications, President Donald Trump has officially revoked executive privilege protections for members of the Biden White House, clearing the way for them to testify freely before Congress.

According to a letter from the current White House counsel, executive privilege claims made on behalf of Neera Tanden, one of Biden’s top advisors, were deemed “not justified.” The letter explicitly authorized her to speak openly and honestly about President Biden’s mental fitness, a central subject of a House Oversight Committee investigation.

This bold reversal comes after years of Democrats weaponizing executive privilege against Trump and his allies. In 2022, then-President Biden waived executive privilege for Trump regarding National Archives documents—a key move that led to the Mar-a-Lago raid, Trump’s indictment, and the broader classified documents saga. That gambit almost succeeded… until Trump returned to power.

Tables Have Turned

Back then, Democrats argued that Trump shouldn’t be allowed to shield former officials or documents from public scrutiny. They claimed the urgency of transparency overrode precedent—and now, they’re watching those very standards turn against them.

At the center of the latest controversy is the House Oversight Committee’s probe into Biden’s cognitive health, a topic that’s exploded into the national conversation after years of denial and heavily staged public appearances. GOP lawmakers are demanding to hear from former Biden staffers who witnessed his condition behind closed doors. Until now, those individuals could have hidden behind claims of privilege.

But Trump’s White House just pulled that card out of the deck.

The irony is biting. Biden and his handlers assumed they’d remain in power long enough to ensure their executive privilege decisions would only cut one way—against Trump. But they set a precedent, and now Trump’s merely following their lead.

Biden had also invoked executive privilege to block the release of his audio testimony with Special Counsel Robert Hur, a recording that reportedly painted a disturbing picture of mental decline. That claim lasted through the 2024 election. But that sort of selective shielding won’t fly anymore.

Trump’s message is clear: if Democrats insisted on dismantling long-standing executive norms to attack their political enemies, they’ll have to live under those same rules now that the power tables have turned.
